Strata disputes

Strata disputes are disagreements involving a strata corporation, its council, owners, tenants or occupants, such as bylaw enforcement and fines, repair and maintenance responsibilities, water leaks, levies, access to records and decisions made at meetings. In BC, most of these disputes go first to the Civil Resolution Tribunal rather than to court.

How BC law treats it

The Civil Resolution Tribunal has jurisdiction over most strata property claims under the Civil Resolution Tribunal Act, SBC 2012, c 25, subject to exceptions, with remaining matters heard in the Supreme Court of British Columbia. The basic two year limitation period under the Limitation Act, SBC 2012, c 13 generally applies.

What it means for your business

Raise issues in writing early, request a council hearing where available, and keep records of leaks, complaints and correspondence.

Risks and common mistakes

Filing in the wrong forum or missing the limitation period can end an otherwise valid claim.
